    CONSTITUTION OF THE ASSOCIATED STUDENT BODY OF MIDDLE COLLEGE HIGH SCHOOL

     

    Preamble: ASB represents MCHS. The experiences and memories created at MCHS is what the student body will carry with them for the rest of their lives. ASB is responsible for creating these memories and experiences. ASB is more than just an acronym, it represents a commitment, a vision, and a promise to our fellow students, school, and community. ASB is the heart and soul of our school, entrusted with a mission which is to serve, lead, and inspire. ASB is the change we wish to see in our school and community. This can only be achieved if all members truly want to be here and do the hard work together. ASB is a family. ASB should never feel like a task, instead it should uplift MCHS.

    ARTICLE I-NAME, MASCOT, AND COLORS

    Section 1        The name of this organization shall be the Associated Student Body of Middle College High School.

    Section 2        The mascot shall be the Wizard (Walter the Wizard).

    Section 3        The colors shall be purple, silver, black, and red.

                           

    ARTICLE II - PURPOSE

    The purpose of the Associated Student Body shall be to promote school spirit, encourage and support school activities, be inclusive of all Middle College High School students in a variety of activities, stimulate high ideals for education and democracy, foster positive relationships among students, faculty, administration and the Board of Education, and to uphold the traditions of Middle College High School.

     

    ARTICLE III - MEMBERSHIP AND PRIVILEGES

    Section 1        All Students enrolled in Middle College High School shall be members of the Associated Student Body, subject to its rules and entitled to its privileges.

    Section 2        Every student enrolled at Middle College High School shall automatically become an active member. Active members are entitled to:

    A. Run and serve in Student Government (Leadership) in accordance with election and appointment guidelines.

    B. Vote in ASB elections and special elections in accordance with election procedures.

    C. Participate in school clubs and organizations in accordance with club constitutions.

    D. Uplift and support all of the Associated Student Body events and activities

    ARTICLE IV - EXECUTIVE CABINET AND EXECUTIVE CABINET AND STUDENT GOVERNMENT (LEADERSHIP)

    Section 1        The Executive Cabinet of the Associated Student Body shall be the President, Vice-President, Secretary, Treasurer, and Historian..

    Section 2        Student Government (Leadership)

    A.         Student Government (Leadership) shall consist of the (5) Executive Cabinet, the Presidents, Athletics Commissioners (2), Communications Commissioner (2), Elections and Data Commissioner, Fundraising Commissioner(2), .If an applicant is fit to be a part of Student Government (Leadership) but all positions are filled, another position may be created or the candidate may be designated to an already existing position and those duties will be shared among the members at the discretion of the elections committee and Activities Director(s).

    B.         The duties of Student Government (Leadership) shall consist of the general promotion and supervision of all student body activities. These duties include handling elections of the ASB Executive Cabinet. These duties also include approval of all student body activities, promoting and producing rallies, spirit weeks and dances, and handling all financial business of the Associated Student Body.

    C.        All members of Student Government (Leadership) shall be voting members, except the ASB President who may vote only in the case of a tie.

    Section 3        All Student Government (Leadership) Members of the Associated Student Body shall serve until they graduate, are removed, or resign.

    Section 4        All Student Government (Leadership) members (elected and appointed) must be enrolled in the Student Government (Leadership) class, and shall be required to participate in activities where and when assigned or needed.

    Section 5        Student Government (Leadership) shall work in cooperation and conjunction with the Activities Director(s).

    Section 6        Official Student Government (Leadership) general meetings shall consist of a quorum that shall be defined as a simple majority of the current Student Government (Leadership).

    Section 7        All members of Student Government (Leadership) must maintain at least a 3.0 GPA during their term of service. Receiving “No Credit,” no “F” grade and no more than one “D” grade in the prior two semesters, or “Unsatisfactory” in citizenship during their term of service will result in removal from the Student Government (Leadership) determined by the Activities Director and Middle College High School Administration.

    Section 8        All members of Student Government (Leadership) must abide by the behavioral expectations and rules set in the Middle College Student Handbook. Any student who does not follow school rules and district policies during their term of service will be removed from Student Government (Leadership) as determined by the Activities Director and Middle College High School Administration.

    ARTICLE V - Student Government (Leadership) DUTIES

    Section 1        Elected Positions

    President

    • Shall communicate with the Activities Director and ASB VP regarding all student activities.
    • Shall works with VP to create agendas for each class
    • Shall Discipline/Reprimand\ members-at-large if needed
      • after discussion with Activities Director
    • Shall meet with VP, calendar dates for all ASB events
      • Meet with Principal & Activities Director
      • Write dates in master calendar
    • Shall Plan/Coordinate ASB cabinet meetings
    • Shall Assign/Review commissioner responsibilities to members-at-large
      • Grade commissioner’s fulfillment of tasks
    • Shall Work with VP and Activities Director to assign grades
    • Shall complete all tasks not completed by members-at-large
    • Shall manages School-Wide Remind Account
    • Shall Attend Student Board Meetings

     

    Vice President

                                        Responsibilities:

    •  Shall communicates with the Activities Director and President regarding all ASB activities.
    • Shall take over when president is not present
    • Shall work with President to create agendas for each class
    • Shall Assign/Review commissioner responsibilities to members-at-large
      • Grade commissioner’s fulfillment of tasks
    • Shall complete all tasks not completed by members-at-large
    • Shall help President fulfill their responsibilities

    Secretary

    Responsibilities:

    • Shall keep track of ASB minutes
      •  keeping track of everything that is written on the board & talked about (aka aloud discussions).
      • Notes must be typed.
    • Shall have Chromebook during every ASB meeting, including summer sessions.
    • Shall be able to keep organized notes.
    • Shall share notes with everyone in ASB.
    • Shall Take attendance (non-classroom meetings) and update people who were absent.
    • Shall prepare monthly summary of ASB activities from the previous month.
      • For cabinet meetings
    • Shall Track tasks assigned/completed by members-at-large.
    • Shall attend ICC meetings in order to keep minutes.
    • Shall request approvals (clubs, fundraisers, purchases)

    Treasurer

                                        Responsibilities:

    • Shall keep track of all money related to ASB expenditures & fundraisers.
    • Shall count amount at the start of the selling period and at the end of the period during a fundraiser
    • Shall complete paperwork for ASB fundraiser requests/purchases
    • Shall update the Advisor and Cabinet on spending/costs.
    • Shall work with the Advisor to count money and make deposits after fundraisers
    • Shall assists in fundraisers
    • Shall collect receipts of purchases made by adviser
    • Shall keep track of receipt books and add up total money collected per receipt book at the end of a sale
    • Shall work with Advisor to generate list of sales of ASB stickers and dance tickets
    • Filling out new fundraiser form with help of advisor & secretary
    • Shall lead the fundraising committee where at least (1 or 2) fundraising events will take place each month.

    Section 2        Appointed Positions

     

    Historian

                                        Responsibilities:

    • In charge of the ASB social media account.
      • Instagram
    • With publicist, creates hashtags for ASB events
    • Must post constantly, at least twice a week.
      • What will you post?
        • ASB meetings
        • ASB events
          • Fundraising
          • Dances
          • etc.
        • Post about club events
        • Ask for right requests
        • Community Service/Internship opportunities posts
    • Communicate with/help promote all school clubs.
    • In charge of ASB wall/memory wall.
    • Must take pictures/videos at all events to post.
    • In charge of all online advertising.
    • Need a smartphone
    • Shall post once per week on the Instagram
    • Shall be responsible of reposting
    • Shall market all ASB events on social media
    • Must completely renovate the instagram page and it’s highlights, posts, links, etc.
    • All posts should be aligned with the interests of the student body, hyping up the posts
      • This includes putting music over the stories, making it look aesthetically pleasing, etc.

                           

    Assistant to the Historian  2

                Responsibilities:

    • Shall assist the Historian in their duties
    • Shall help run the ASB Instagram
    • Shall create content for social media.
    • Shall document events with the Historian via photos and videos

                            Head of Materials (5)

    Responsibilities:

    • In charge of keeping the ASB cabinet organized and clean.
      • Monthly check-ups will be done that will affect your grade
    • Do inventory to keep track of what materials we have enough of and what we need to order ahead of time
      • communicate to ASB cabinet to purchase
    • Must clean ASB cabinet every PM Friday (bi-monthly).
    • In charge of making sure brushes are being cleaned well.
    • Organizes brushes in designated spots.
    • Have a check out list that keeps track of when non-ASB members want to borrow supplies.
    • Works with advisor and treasurer to purchase needed supplies
    • Makes purchases of needed supplies for all events
      • meets with treasurer for reimbursements

     

    Spirit and Pep Commissioner (4)

    Responsibilities:

    • Insuring participation of ASB members & school in all spirit weeks.
      • Assigns spirit week grades to ASB members
      • Makes sure all asb members take of picture of their spirit week outfits each day for a grade
    • Conduct ASB spirit week brainstorming sessions
    • Present nooner ideas to class.
    • In charge of keeping track of spirit points.
      • Using Google Sheets
        • Include name of each event/nooner, place of each class, and points won
    • Communicates spirit point totals to publicist/historian to share with student body
    • Responsible for boosting school was participation during Spirit Weeks
      • Use raffle tickets and raffle? spirit points? To encourage participation
      • Come up with incentives like candy, a gift card, lunch with the counselor, etc.
    • Gather student body feedback to ensure the best school spirit
    • Making sure the spirit point tracker is easily seen by the student body.
      • Present spirit points totals in seminar, or morning announcements
    • Plan/Host end of the year “Most Spirited Class” gathering with a date
      • pizza? Ice cream? gift? dance? Movie night? Etc.
      • Have a plan before the new school year begins to hype it up all throughout the school year and encourage participation
    • Fulfill member-at-large responsibilities

                            Publicity Commissioner (2)

    • Shall report to Historian, Heads of Physical Media, Commissioners of Video Productions, Club Liaisons, Communication Commissioners,  President, and Vice President
    • Emails Ramos dates/times that ASB would like to use seminar to promote events
    • Assign a slide for each seminar presentation to a different pair until it goes all around the class and then rotation begins again
      • Make sure that the website link is always included in the presentation
    • Works with pep commissioners to share spirit point totals to the student body.
    • Works with historian to create hashtags and manage social media accounts.
    • In charge of creating all morning announcements and emailing them to the Advisor beforehand.
      • Promotes/publicizes all ASB events
    • Supervises website and makes sure it is up to date
    • Must have grammar/english skills

                            Head of Physical Media (2)

    • Assigns all ASB posters.
    • Works alongside the dance commissioner to assign decorations
    • Keeps track of/grades finished posters.
      • Posters must be posted for full grade
      • Posters must be neat, creative, aesthetically pleasing, and presentable.
      • Can not be biased.
      • Makes sure posters are completed on time or ahead of time.
      • Needs to grade posters on ability and effort.
    • Keeping track of assigned posters to distribute work fairly, based on artistic skills of all the members
    • Will communicate with flyer commissioner to create flyers aligning with the events
    • Needs to go through ASB previous posters and see which to keep and which ones to throw away
      • make sure supplies are returned.

                            Flyer Commissioner (2)

                                        Responsible for:

    • Create flyers for advertising ASB events, games, and other news.
    • Design engaging and aesthetically pleasing flyers.
    • ticket designs
    • Print and hang flier in each classroom and boards on campus.
      • Must be done on time to promote asb events
    • Send flyers to historian to post on instagram

     

                            Commissioner of Video Production (2)

    Responsibilities

    • In charge of all ASB promotional videos & TikTok account.
      • with help of ASB members-at-large
    • Make sure they are done in time in order to have time to promote the video.
    • Film/edit videos.
    • Come up with entertaining ideas that will capture the attention of the student body
    • Must follow up with trends
    • Post at least once a month
    • In charge of assigning 4-15 people to help in production.
    • In charge of keeping track of participation from chosen members.
    • Needs to report to ASB Pres/Vice about participation.

                            Clubs Liaison (2)

    Responsibilities

    • Shall administer the activities of the Inter Club Council (ICC), shall preside at its quarterly meetings minimum
    • Shall be responsible for club application approval.
    •  Shall be responsible for creating and publicizing club list with advisor, president, contact information, and meeting time/location.
    • Shall be responsible for coordinating Club Rush
    • Shall be responsible for the management of accountability of MCHS clubs.
    • Shall be intentional in constantly looking for strategic collaboration opportunities for ASB and clubs.
    • Shall be responsible for highlighting a different club each week with the Historian social media.

                           

    Class Presidents (3)

    Responsibilities:

    • Must create sources for students to get their voice heard
      • Interviews
      • Surveys
      • Polls
    • Create an ig account where they will repost and promote all of the asb events
    • Find opportunities and services for their class
    • Every other month host a meeting for the students
    • Talk one on one with students about what is wanted and needed
      • Sometimes walk around during lunch to ask students what he or she feels
      • Take notes and report back
    • Must communicate back with ASB, ASB president, and ASB vice president
    • Made sure that everything is created on time
    • Talk to President and Vice about what polls and surveys are wanted
    • Talk to every grade level about events and wishes
      • Not just to his or hers friend group
    • Talk to club presidents in grade level
      • Communicate what their clubs want/need
    • Come up with a way to improve or any feedback heard from class at least once every week

     

                            Commissioner of Appreciation (2)

    Responsibilities

    • Create birthday cards for each student, which will be handed out during our monthly seminar lessons
    • Reminding Pres and Vice if an ASB members birthday is coming up
    • Helping Pres and Vice plan for what they should do for an ASB member birthday
    • Finding out teachers and staffs birthdays
      • Doing something special for them
    • Giving clubs and clubs president's recognition
      • Once a month choose a club president and club to talk about during seminar
      • Doing something special for them
    • Shall Plan and coordinate Holiday & End of Year ASB gathering
    • Work on any gifts or senior goodbye activities

                            OCL Commissioner (2)

                                        Responsibilities:

    • In track of making sure everyone is turning in their money.
    • Make sure costumes or doable/on budget.
    • Make sure costumes are done in time.
    • In charge of snacks for OCL.
    • In charge of coming up with chants and teaching them to class  communicating them with the chants commissioner
    • At OCL, in charge of leading chants alongside chants commissioner.
    • In charge of bringing spirit gear (pom poms, noise makers, etc.).
    • In charge of doing some fundraisers over the summer to gain money for OCL (needs to communicate with treasurer).
    • Presents a little overview of what ocl is like to know what to expect in the beginning of summer.

                            Choreography Commissioner (2)

    Responsibilities

    • In charge of choreographing dances and teaching them.
    • In charge of coming up with dates to practice and communicating them with the class and ASB president and ASB vice president
    • Explaining and presenting the dance to the ASB class

     

    Student Affairs Commissioner

                            Responsibilities

    ● Shall be responsible for the activities in connection with the election of students to winter formal court and ASB president & VP.

    ● Shall coordinate & organize ALL Google survey’s to the student body and will present data to ASB Student Government (Leadership).

    • Creating forms for event ideas/suggestions, spirit week ideas, anonymous criticisms/feedback
    • in charge of making sure all items are purchased (sash/flowers)
    • Creating a box that will be put into the lounge where students will be able to slip in comments/feedback/ideas/criticisms
      • It will completely covered and sealed so only ASB can read what is said
      • Must be aesthetically pleasing
      • In charge of checking if there was anything put in the box. If there was, then they are in charge of bringing it back into the ASB classroom and communicating giving it to the ASB president and ASB vice president

                            Fundraising Commissioner (3)

    Responsibilities

    ● Shall be responsible for receiving fundraising applications and sending notices of approval

    ● Shall maintain the fundraising calendar.

    ● Shall manage all student fundraising in conjunction with the school’s ASB treasurer.

    ● Shall coordinate the involvement of all outside fundraising groups.

    ● Shall assist the Commissioner of Appreciation with “balloon grams” fundraiser.

    • Must come up with a fundraising event every month
    • Must contact at least one big company once every other week per person
    • Communicate with treasurer on any ideas or plans
    • Must present any ideas to the ASB class

                           

     

    Communication Commissioner (1)

                                        Responsibilities

    • Shall organize broadcasting monthly for seminar lessons
    • Shall promote good communication ties to students, faculty, and the community.
      • Create a group chat on remind with staff letting them know about any events or anything that they should know that we will be doing
    • Shall be responsible for managing and editing calendar, strategies, and plans for all activities and events.
    • Shall be responsible for maintaining the ASB School calendar with the ASB president and vice to ensure all activities are advertised.
    • Shall be responsible for maintaining/updating the monthly calendar in the office

                            Commissioner of Athletics (2)

                                        Responsibilities

    • Shall be Volleyball captain for OCL
    •  Shall collaborate with Spirit and Pep Commissioners for building school spirit at important games such as battle of the bay or other rivalries, league championships, and playoffs.
    • In charge of brining equipment to help teach students during summer meetings
    • Must organize and lead the teacher vs. students games that will be taking place throughout the school year
    • Collaborate with the sports spirit squad (ran by Ms. Montes) to raise the sports spirit
    • With the help of asb, gather posters, pom-poms, streamers, balloons, etc. to take and decorate on game-day
    • Organize the pep-rallies that will be taking place
      • Getting the list of names
      • Create the pep-rally poster
      • Work with asb to create the games that will be played in the pep-rally

                           

     

     

     

    Commissioner of Fine Arts

                                        Responsibilities

    • Work with Club Liaison to Keep ASB updated with other club events
    • Arrange for ASB members to attend two productions/events other than ASB’s per semester
    • in charge of communicating with club liaison in regards to club participation in assemblies
    • must work with clubs in coming up with a game related to their clubs

                            Commissioner of Prom Committee

    Responsibilities

    • Shall contact venues and work with the Activities Director to plan the event
    • Shall work with the Fundraiser Commissioners
    • Shall be in charge of the Prom Committee
    • Communicate all information to the asb president and asb vice president, updating them on the daily

                           

    Commissioner of Internal Relations

                                        Responsibilities

    • Develop and plan ASB class bonding activities and events either off or on campus
    • Help organize the ASB room(s) to make them efficient and clean
    • Speak with individual team members if they are not working on assigned duties, and report to ASB president and/or Activities Director with any concerns.
    • Supervise that all the work is being done

     

    Master of Ceremony

                                        Responsibilities

    • Shall be in charge of emceeing all ASB events
    • Shall develop an outline for the events
    • Communicate with ASB to make sure that everything is included in the outline

                            Dance Commissioner

                                        Responsibilities (2)

    ● Shall be responsible for organizing and managing the Halloween Dance, Winter Formal, and other campus-related dances. This includes, but is not limited to, the establishment of a budget, securing entertainment and decorations for dances, and adherence to the decisions of the ASB Student Government (Leadership) with regards to the dance themes, etc.

    ● Shall be responsible for coordinating with Dance Courts for acceptance of nomination, participation in rallies and attendance at coronations

    ● Shall be responsible for collaborating with the Publicity Commissioners for advertising dances

    ● Shall work with the Elections Commissioner to coordinate Dance Court Elections and will be responsible for the purchasing of crowns, sashes, etc. as well as communicating with the dance courts for rallies and dances

                            Audio Commissioner

                                        Responsibilities

    ● Shall be in charge of setting up audio equipment

    ● Shall be in charge of creating playlists

    • Must have diverse music taste
    • Must have access to ad free music (Apple Music, Spotify Premium, YouTube Red, etc.)
    • Must learn how to use the mixer

    Game Master

    Responsibilities

    • Shall be in charge of creating all student games for events
    • Shall decide who picks participants
      • Runs random roulette (random student picker) if necessary
    • Shall be leader of Game Committee (Section 3)
    • Shall be responsible for coordinating with staff for necessary equipment
    • Shall be responsible for communicating with other positions and/or committees for needs

    Merch Director

    Responsibilities

    • Makes sure all merch concepts meet requirements
    • Collects all merch concepts for dissemination across staff for voting
    • Leader of Merch Committee
    • Brainstorm popular merch ideas (w/ Merch Committee)
    • Assign people to draw out merch concepts
      • Communicating with Flyer Commissioner (advertising positions/committees) for out-of-ASB participants
    • Come up with dates to sell
    • Communicate with advertisements to promote merch

    ARTICLE VI - CLASS COUNCIL & INTER CLUB COUNCIL

    Section 1        Inter Club Council

    A. The Inter Club Council shall consist of the appointed Club Liaison (2) and the Club Presidents. The presiding officers of the Inter-Club Council shall be an appointed position and named Club Liaison.

    B. The purpose of the Inter Club Council shall be to represent the student population as a communication link between the administration and the students of Middle College High School. Inter Club Council will participate in the planning and implementation of given student body activities pertaining to all MCHS Clubs and Organizations.

    C. The Inter Club Council shall conduct quarterly meetings and serve until the end of the school year.

    ARTICLE VII - ELECTION AND APPOINTMENT PROCEEDINGS

    Section 1        Candidate Qualifications

    A. Shall be currently a member of Student Government (Leadership) in good disciplinary standing.

    B. Shall have a GPA of at least 3.0, have not received an “F” grade and no more than one “D” grade in the prior two semesters.

    C. Shall not have no more than one “unsatisfactory” mark in citizenship in high school or during the semester prior to candidacy.

    D. Any action which violates Education Code 48900 (reasons for suspension) shall result in ineligibility of the candidate.

    E. The student may also not have a history of attendance problems (cuts, excessive absences, tardies) as determined by the Activities Director(s), the Administration and school policy.

    F. Shall not have a disciplinary suspension/transfer during high school or the year prior to the school year of candidacy.

    G. Shall comply with all school and district policies.

    H. Shall attend official Student Government (Leadership) events throughout the school year in which they serve and summer prior.

    I. Shall be a member of the class in which the position they are running in serves, in the case of an elected position.

    J. Shall have at least one year of prior Student Government (Leadership) experience and be a senior class member at Middle College High School in order to run for the following:

    i. ASB President

    ii. ASB Vice President

    K. All standards mentioned in Article VII, Section 1 must be maintained during tenure.

    L. All standards in Article IV apply.

    Section 2        Respective Electorates

    A. The following positions shall be elected by the Associated Student Body in its entirety.

    i. ASB President

    ii. ASB Vice President

    Section 3        Election Proceedings

    The Elections Committee, which shall be appointed by the Activities Director(s), will include the Student Government (Leadership) Executive Cabinet and Elections Commissioner, and shall be responsible for the oversight and execution of the election proceedings.

    A. All candidates must do the following to be eligible for candidacy:

    i. Selected candidates shall present a speech before the Associated Student Body.

    ii. Shall follow the official election rules, guidelines and regulations determined by the Elections Committee and Activities Director(s).

    iii. Any negative campaigning against another candidate for any office will immediately revoke eligibility. Including but not limited to social media posts, visual, verbal, and physical bullying, along with harassment through candidate peers.

    B. Candidates shall be allowed at least five days of campaigning prior to the official election.

    C. The Activities Director(s) and the Executive Cabinet shall be responsible for the interpretation and enforcement of rules and regulations pertaining to eligibility of candidates and elected and appointed student leaders of the school.

    D. No student shall be eligible to hold office after attending high school for more than four years.

    Section 4        The Elections Committee of the Student Government (Leadership) shall be able to temporarily augment and determine election proceedings in order to ensure an efficient election process.

    Section 5        Elected and Appointed Removal

    A. All members of the Student Government (Leadership), elected or appointed, are subject to removal from office for any and all of the following reasons:

    i. Repeated failure to attend ASB events and official meetings.

    ii. Dereliction of the duties and responsibilities of their respective office.

    iii. Repeated failure to represent the Associated Student Body in a manner and behavior expected of the office as determined by school policies, the Activities Director(s), and Administration.

    iv. Failure to maintain the academic and behavior standards aforementioned in Article IV, Section 7 of this Constitution.

    v. Action showing obvious and intentional disregard and disrespect of the Associated Student Body, Faculty, or School.

    vi. Other exigent circumstances determined by the Administration and Activities Director(s) to warrant removal from office.

    B. Removal shall be determined by the Student Government (Leadership) Cabinet, with the final authority of action to lie with the Activities Director(s) and Administration.

    C. Upon vacation of office due to removal, a member of the Student Government (Leadership) may be appointed to fulfill the duties and responsibilities of the office according to Article V.

    Section 6        Resignation

    Any member of the Student Government (Leadership) may resign from office due to inability to faithfully execute the duties and responsibilities of their office.

    A. An official Writ of Resignation must be submitted to the Student Government (Leadership) Cabinet by the member requesting resignation.

    B. The ASB President and Activities Director(s) shall be responsible for approving such Writ of Resignation.

    C. Any elected office or appointed duties left vacant due to resignation may be filled by a member of the Student Government (Leadership) according to Article V.

    Section 7        Vacancy and Succession

    Upon vacancy of elected office for reasons of removal, recall, resignation or incapacitation, the following procedures shall be adopted:

    A. Upon vacancy of the office of ASB President, the following succession proceedings shall be enacted:

    i. The ASB Vice President shall assume the duties and responsibilities of the office of ASB President.

    ii. Student government will appoint the ASB vice president after an election. The candidates for ASB president shall be the runner up from the previous election.

    iii. If the ASB vice president is unable to assume the duties and responsibilities of the office of ASB President, the line of succession shall proceed as follows:

    a) ASB Secretary

    b) ASB Treasurer

    c) ASB Historian

    iv. Holding two offices simultaneously due to succession proceedings in Article VII shall entail the duties and responsibilities of both offices to the member of Student Government (Leadership) holding such offices.

    B. Upon vacancies of the offices of ASB Vice President, ASB Secretary, ASB Treasurer, and Historian, the Student Government (Leadership) members shall appoint a member of Student Government (Leadership) to assume the duties and responsibilities of such offices.

    I. Candidates eligible for appointment to the offices of ASB Vice President, ASB Secretary, and ASB Treasurer may come from the Student Government (Leadership) in general.

    ii. Holding two offices simultaneously due to succession proceedings in Article VII entail the duties and responsibilities of both offices to the member of Student Government (Leadership) holding such offices.

    C. Upon vacancy of appointed office for reasons of removal, resignation or incapacitation, the Student Government (Leadership) class may elect a member of the  Student Government (Leadership) to assume the duties and responsibilities of such office.

    Section 8        No member of Student Government (Leadership) may hold more than one elected office simultaneously, with the exception of succession proceedings and appointments specified in Article VII.

    Section 9        All Student Government (Leadership) members must be committed to attending OCL during the summer, unless a valid reason can be given.

    Section 10      All Student Government (Leadership) Members are expected to be knowledgeable about school rules and regulations pertaining to student conduct and to follow them, setting the proper example for other students. A history of disciplinary violations, coupled with requests from school officials to adhere to school rules is grounds for removal or suspension from office. Possession, use, or publicizing the use of alcoholic beverages or any controlled substance on campus or at any school function will result in immediate resignation or removal from office and/or Student Government (Leadership).

    ARTICLE VIII - ASSOCIATED STUDENT BODY DISBURSEMENTS

    Section 1        ASB funds may not be spent without the approval of both the Student Government (Leadership) members and the school administration.

    Section 2        Prior to the expenditure of any ASB funds, an ASB disbursement form must be filled out and signed by an authorized officer (if any) and the advisor of the organization to be charged. Then the disbursement and request must be approved by a majority vote of the Student Government (Leadership) and signed by an ASB officer. Final approval must then be secured from the Administration with the signature of the Principal, or his/her designated representative before the expenditures are made.

    Section 3        Goods and/or services requiring payments from student body, class, club or other organization funds are not to be ordered without prior approval of both the Student Government (Leadership) and the school Administration.

    ARTICLE IX - SCHOOL WIDE ORGANIZATIONS

    Section 1        Any member of the Associated Student Body, notwithstanding circumstances of reprimand, may petition the Student Government (Leadership) members to form a club on campus.

    A. In order for a petition to be considered, the club must have a completed application as well as a member of the Faculty to serve as an official Advisor.

    Section 2        Once a petition is granted, a request for charter shall be submitted to the Inter Club Council Commissioner, with such a charter to include the following:

    A. Statement of purpose

    B. Signatures of all leadership members, as well as the Faculty Advisor.

    C. Official Club Constitution to include, but not limited to the following:

    i. Club name

    ii. Club purpose

    iii. Club membership and officers

    iv. Club elections and installations

    v. Club meeting times and locations

    vi. Advisor commitment statement

    Section 3        Such a request for a charter shall be approved by the Student Government (Leadership) Members, Activities Director(s), and the Administration of Middle College High School.

    Section 4        The purpose of any club or organization shall be consistent with Santa Ana Unified School District policies and regulations.

    Section 5        Failure of a club to comply with the rules and regulations shall be subject to potential probation and dissolution. A warning shall be issued to the club officers and Faculty Advisor(s) prior to reprimand from Student Government (Leadership).

    Section 6        Each club must reapply for charter status at the beginning of each school year and new clubs may be chartered at the beginning of each semester.

    Section 7        All ASB organizations must receive approval from Student Government (Leadership) and/or the Middle College High School administration before making financial obligations. Money earned by ASB organizations must be spent for the benefit of the students of Middle College High School unless specifically permitted in advance by Student Government (Leadership) and the Administration.

    ARTICLE X - Process of Removal from ASB

    Section 1         The removal process is in place to remove any member that does not represent what ASB stands for as stated in the preamble of this constitution. Removal from the class is determined by the school’s administrator and ASB adviser pursuant to the regulations outlined below.

    Section 2        Steps Required for Removal: 

    1. Initial Warning: Should an ASB member fail to fulfill the responsibilities of their position as outlined in article V, sections 1 & 2 and abide by the ASB Code of Conduct they will be issued an initial warning by the ASB president with the approval of the ASB advisor. The warning serves as a gentle reminder of the expectations and provides an opportunity for self-reflection and improvement.
    2. Guardian Notification: If the issue persists following the initial warning, the ASB advisor will contact the member's guardians. This communication will inform the guardians of the behavior in question and the subsequent steps that will be taken if no change is made. The schools administration will be notified of the infraction and violation and guardian notification.
    3. Meeting with Administration for removal: Should the member fail to heed the final chance or demonstrate continued non-compliance, they will meet with the advisor and administration to begin the process of immediately being removed from the ASB. This decision is made in the interest of maintaining the integrity and effectiveness of our organization.

    Section 3        Loss of Applying Privileges: Individuals who are removed from the ASB due to non-compliance will not be eligible for reapplication.

    ARTICLE XI - Code of Conduct & Expectations

     

    Section 1        Expectations

    1. Attend all meetings, events, and activities unless excused in advance.
    2. Outline expectations for behavior, professionalism, and respect among ASB members, both within the organization and in interactions with peers, staff, and the community.
    3. Must support and NEVER talk negatively about ASB, peers in ASB, or any of it’s events.
      1. If this is done, the removal process will immediately move up to step two of the removal process
    4. Clearly define the roles and responsibilities of each ASB position, including specific tasks, deadlines, and expectations for participation in projects and initiatives.
    5. Promote all ASB events and convince peers to participate.
    6.  Establish guidelines for maintaining confidentiality regarding sensitive information discussed within the ASB
      1. This can be topics such as financial matters, personnel issues, or private discussions.
    7. Actively participate in and support school events, activities, and initiatives, setting expectations for involvement and representation as student leaders.
    8. Adhere to all school policies, regulations, and guidelines, including those related to conduct, attendance, academic eligibility, and any other relevant areas.
    9. During designated ASB hours, members are expected to remain fully engaged in ASB-related activities and responsibilities.
    10. This includes refraining from working on assignments, playing games, or tasks for other academic courses.

    Section 2        Academic Achievement

      1. I will maintain an academic 2.75 GPA computed on a 4.0 scale
      2. If I receive less than a 2.75 GPA during any term, I understand that there will be consequences and limitations to my involvement in ASB. Receiving less than a 2.75 could be cause for dismissal from ASB by the schools administration and ASB adviser.
      3. I understand I may be asked to submit a record of my scholastic achievements to the ASB adviser at the end of each grading period.
      4. Receiving “No Credit,” an“F” grade and more than one “D” grade in the prior two semesters, or “Unsatisfactory” in citizenship during their term of service could be cause for dismissal from ASB by the schools administration and ASB adviser, or reason to not be readmitted.

    Section 3        Behavioral Standards

      1. As a member of ASB, I realize that my conduct must be beyond reproach at all times, on and off campus, and in every class. (It is critical that you understand the full implications of this statement. Violation will result in dismissal from the class. Ask Mr. Ramos if you need further explanation.)
      2. I will uphold the ASB constitution
      3. I will cooperate with and support the ASB Cabinet & ASB adviser.
      4. I will abide by school dress regulations at all times.
      5. I will not carry or use any illegal substances or stimulants, drugs, alcohol, etc. at any time, on and off campus.
      6. I will display good sportsmanship at all times
      7. I will maintain a satisfactory citizenship/attendance record.
      8. I understand that if I am suspended from Middle College High School, I may be suspended from ASB temporarily or permanently, as determined by the school’s administrator and ASB adviser.
      9. Posting of negative material on campus, on social media, etc. will result in immediate removal.
      10. Inappropriate conduct in any MCHS course/event will result in an immediate review and possible removal.
      11. Any report of misconduct by a MCHS teacher will result in an immediate review and possible removal.
      12. Bullying, speaking negatively of, or spreading rumors of any MCHS student will result in an immediate review and removal.
      13. Failure to comply with any of these rules may result in immediate removal from the class as determined by the school’s administrator.

    Section 4        Leadership Class

      1. Attendance is mandatory.
      2. Frequent absences or tardiness will lead to removal from the class.
      3. After school, before school, lunchtime, and other predetermined meeting times are also mandatory, expect to be at school as early as 6:45am and as late as 9:00pm for some events.
      4. Participation in ALL ASB events is also mandatory and required (unless dismissed by the adviser)
      5. Your grade in the class will be adversely affected by a lack of participation in ASB hosted events.
      6. Your grade in the class will be adversely affected if you fail to complete assigned tasks and duties.

    Section 5        Responsibilities of Membership

     

      1. I understand that attendance to class/meetings is mandatory
      2. I understand that the same school rules apply in this classroom as any other.
      3. I understand that I am not to use my cell phone in class. Class time will be used for planning and executing school events.
      4. I understand that it is my responsibility to work on projects/ assignments given to me during class periods.
      5. I understand that, regardless of my position, I will be assigned various tasks that deal with all aspects of ASB.
      6. I understand that I will be assigned work tasks at all ASB functions and that it is my responsibility to work at ASB events.
      7. I understand that being on ASB is a huge time commitment. I am prepared to work during break, lunch, after school, and some evenings to fulfill my duties.
      8. I understand that I am expected to set up and clean up after all activities.
      9. I understand that I will be assigned, and expected to execute, tasks by the ASB advisor and /or the ASB President.

     

     

    ARTICLE  - Applying and Reapplying Process

     

    Section 1        The application process for the following school year happens during the months of March-April of the current school year. The applications are reviewed by the ASB advisor, who then selects the new members based on the following criteria:

    1. a short (2-3 min) talent/skill showcase video
    2. two teacher recommendations
    3. an essay, or short answer question responses
    4. community service and extracurricular involvement
    5. Verified GPA
    6. Review of absences/tardies

    Section 2        All current members must reapply for admittance at the end of each school year.

    ARTICLE XII - INTERPRETATION OF THE CONSTITUTION

    Section 1        The Student Government (Leadership) shall interpret this constitution for the Associated Student Body of Middle College High School.

    ARTICLE XIII - ADMINISTRATIVE INTERVENTION

    Section 1        Because the power of this constitution is granted to the Associated Student Body by the Principal of Middle College High School and the Santa Ana Unified School District Board of Education, and their power is in turn granted by statue of the State of California, all decisions and activities of the Student Government (Leadership) are subject to the approval of the Principal or his/her designated representative(s). The Principal, as the representative of the Board of Education, is responsible for the welfare of the students, and may intervene or deny any activities proposed by the Student Government (Leadership) as well as the Associated Student Body.

    Section 2        The Administration and Activities Director(s) reserve the right to remove or deny a candidate from office, or any other Student Government (Leadership) member, due to issues of discipline or exigent circumstances.

    ARTICLE XIV - AMENDMENTS

    Section 1        Any member of the Associated Student Body may propose constitutional amendments. Proposed amendments shall be put to a vote of the Associated Student Body if they are first passed by a simple interest vote of the Student Government (Leadership). Amendments shall be ratified by a simple majority of the voting members of the Associated Student Body as well as the consent of the Activities Director(s) and Principal of Middle College High School.

    Section 2        Administration and Activities Director(s) may propose changes to the constitution. These constitutional changes shall be put to a vote by members of Student Government (Leadership) with a two-thirds majority vote for the amendment to be ratified.

    ARTICLE XV - RATIFICATION

    Ratification of this Constitution shall require a two-thirds vote from Student Government (Leadership) present at an official Ratification meeting, as well as the consenting signature of the Activities Director(s), Student Government (Leadership) Members, and Principal of Middle College High School.

    ARTICLE XVI - POWERS NOT SPECIFIED

    The powers not delegated to the Associated Student Body or Student Government (Leadership) members by the Constitution, nor prohibited by the Santa Ana Unified School District, are reserved to the Activities Director(s) respectively, or to the Student Government (Leadership) Executive Cabinet.

    ARTICLE XVII - EQUALITY FOR ALL STUDENTS

     

    The Santa Ana Unified School District Governing Board along with Middle College High School is committed to providing equal opportunity for all individuals in education. District programs, activities, practices, and employment shall be free from discrimination, harassment, intimidation, and bullying based on race, color, ancestry, national origin, ethnic group identification, age, religion, marital or parental status, physical or mental disability, sex, sexual orientation, gender, gender identity or expression; the perception of one or more of such characteristics; or association with a person or a group with one or more of these actual or perceived characteristics. This policy applies to all acts related to school activity or school attendance within a school under the jurisdiction of the Superintendent.
